Terms and conditions

Contractual partner:

The activity of Disfruta Conil is the mediation of holiday accommodation for the respective owners. The contractual relationship is always between the owner and the tenant. The accommodation is provided to the tenant exclusively for use during the booked travel period.

Rental conditions:

Upon receipt of the client’s written booking confirmation, we will send a reservation confirmation and all information necessary at that time. Upon receipt of the deposit indicated in the reservation confirmation, the contract is valid and the client thus accepts the general terms and conditions.

The deposit of 25% of the rental price is to be paid at the latest 7 days after receipt of the reservation confirmation and the balance of 75% of the total price is due 4 weeks before arrival.

For bookings at short notice, less than 4 weeks before arrival, the total price is payable immediately.

The rental prices include all additional costs such as final cleaning, bed linen and towels (one set per person), electricity, water, gas, taxes and fees. In the winter months November to March inclusive, heating costs are billed separately.

A security deposit must be paid by bank transfer or in cash on the day of arrival. The amount depends on the respective accommodation and is shown separately in the booking confirmation (between 100€ and 600€).

In the case of payments by credit card (Visa or Mastercard, 1.5% surcharge), you will receive a link from us to the payment portal Stripe, through which you can make the payment.

Cancellation conditions:

The tenant can of course withdraw from his booking. In this case, however, a cancellation fee is payable.

Up to 61 days before arrival 25% of the total amount

60 to 31 days before arrival 50% of the total amount

30 to 15 days before arrival 80% of the total amount

From 14 days before arrival 95% of the total amount

Disfruta Conil recommends taking out travel cancellation insurance, for example with Ergo Reiseversicherung (www.reiseversicherung.de).

There is no right to a refund in the event of late arrival, early departure or non-utilisation of services.

Tenant obligations:

– The accommodation must be left as follows on the day of departure: The dishes must be washed, the rubbish must be disposed of and we ask our clients to leave the accommodation swept clean.

If this is not the case when the cleaning teams arrive, Disfruta Conil, on behalf of the landlords, has the right to charge the tenant for the extra cleaning work.

  • The tenant has a duty to treat the rented accommodation properly. Any damage or defects that occur must be reported immediately to Disfruta Conil. The repair of the damages or the removal of defects must be accepted by the tenant during his stay.
  • In strong winds, the sunshades must be closed and the sun awnings retracted. Cushions and pads of outdoor furniture must be brought into the dry in case of rain and in case of existing sprinkler systems.

Termination of the contract by Disfruta Conil or by the landlord, as the case may be:

If, despite being warned, the client behaves in breach of the contract, Disfruta Conil has the right to terminate the contract on behalf of the landlord without notice and without the right to a refund. Examples are the following:

  • Occupancy of the house with more people than previously announced.
  • Bringing pets without prior notice. The landlords only allow pets in individual cases.
  • Extreme noise pollution from customers (parties and bachelor parties are not allowed).
  • Grossly negligent damage to the accommodation or the inventory

Change of bookings:

Should the tenant wish to change the booking for the booked accommodation and should this be possible after consultation with the landlord, we can organise this in most cases without additional costs. In individual cases, a rebooking fee of 50€ will be charged.

Rebookings to other accommodation are generally not possible without additional costs. They are usually treated as a cancellation of the originally booked accommodation (see cancellation conditions) and as a new booking of the new accommodation.

Arrival and departure times:

The accommodation can be occupied from 5 pm on the day of arrival and must be vacated by 11 am on the day of departure at the latest.

In exceptional cases, an earlier arrival or later departure is possible. However, this must be arranged in advance with Disfruta Conil.

Smoking:

Please note that smoking is not permitted inside the accommodation. Please use the gardens or terraces for this purpose.

Other:

In rare cases, there may be short-term power, water or internet outages. These are no reason for complaints. The same applies to the appearance of ants or other vermin. In these cases, we make every effort to remedy the situation as quickly as possible.

In the case of construction work in the immediate vicinity of your accommodation, which causes severe noise or dust, Disfruta Conil has the right to find you alternative accommodation of equal or greater quality.

Accommodation with a garden or swimming pool requires a regular visit from the gardeners. It must be ensured that staff are granted access. Normally, the staff does not have fixed days or times to carry out the work. However, we make every effort to inform you about the visits in advance.

Children are never allowed to be unsupervised in the pool area or on roof terraces.

Disfruta Conil accepts no responsibility for accidents of any kind during your stay.

Please note that your luggage is not insured during your stay. It is advisable to take out appropriate insurance if this is not available.

The place of jurisdiction is Chiclana de la Frontera (Cádiz).
